Whiskers and Soda Cat Cafe ADULT Release and Indemnification Agreement

I, named below and (hereinafter “I”), hereby certify that I am over eighteen (18) years of age, and am of sound mind at the time of the execution of this Release and Indemnification Agreement (hereinafter “Release”) and agree to the following:
1. WHISKERS AND SODA CAT CAFÉ has available certain cats to be played with by customers at WHISKERS AND SODA CAT CAFÉ and agrees to allow me to play with same in consideration of both the payment of the fees for same and my execution of this Release and agreeing to be bound by its terms.
2. I am aware of and fully understand the inherent dangers involved in playing with cats and other live animals, including the risk of personal injury or damage to myself, other persons, my property, and/or the property of others while participating in such activities or having my property at the site of such activities. I freely and voluntarily execute this Release with such knowledge and assume full and sole responsibility for personal injury and/or property loss arising from or in any way connected with my participation in the activities provided by WHISKERS AND SODA CAT CAFÉ.
3. I am aware that WHISKERS AND SODA CAT CAFÉ serves food and beverages on the premises, and that free-roaming cats have access to the dining and food/beverage preparation facilities. I absolve WHISKERS AND SODA CAT CAFÉ from any liability associated with possible consequences of consuming any food or drink products served at the café in this regard.
4. I agree to abide by all rules and regulations that WHISKERS AND SODA CAT CAFÉ may impose regarding the cats. I agree to follow all rules and to undertake all activities in a responsible manner. IF I AM UNWILLING OR UNABLE TO FOLLOW ANY RULES, WHISKERS AND SODA CAT CAFÉ WILL TERMINATE MY CONTINUATION OF SUCH ACTIVITIES, AND I WILL NOT BE ENTITLED TO ANY REFUND OF FEES.
5. I acknowledge that playing with cats may not be supervised, and WHISKERS AND SODA CAT CAFÉ staff/volunteers will not be with me the entire time I am in contact with the cats, but WHISKERS AND SODA CAT CAFÉ staff/volunteers will remain on the premises to monitor the activity of all current participants, offer guidance and encouragement, and be available to assist in the event of participant difficulty.
6. I have no physical or emotional issue(s), including, but not limited to, any allergies, which would adversely affect my ability to play with the cats or other live animals in a safe and appropriate manner.
7. I agree not to engage in any activity that will injure, frighten, or otherwise hurt the cats in any manner.
8. If I am accompanied by children I assume full responsibility for their actions while in the café and will ensure they abide by all the stipulations contained in this Release, and I am solely responsible for their behavior and actions while on the premises. I also
9. I understand that any reservation cancelled less than 24 hours in advance will NOT be refunded regardless of circumstance.
10. I agree to abide by the following rules and any additional rules given to me by employees of WHISKERS AND SODA CAT CAFÉ:
- Ensure clean hands before petting cats
- Do not pick up the cats without permission and/or supervision
- Do not pull cat’s tails
- Do not stand on furniture
- Do not go into restricted areas
- Do not climb or move cat furniture
- Ask which sleeping cats are okay to pet
- Keep purchased food and drink away from cats, other than purchased cat treats
- Do not make loud noises
- No music, videos, or phone calls without headphones as this will disturb the cats
11. BY EXECUTING THIS RELEASE, I ACKNOWLEDGE THAT I HAVE READ THIS RELEASE, AND ACCEPT FULL RESPONSIBILITY FOR ANY INJURIES OR DAMAGES TO MYSELF OR ANY PERSONAL PROPERTY WHICH MAY RESULT FROM THE VISIT, AND AGREE TO WAIVE ANY CLAIM THAT I MIGHT HAVE HAD NOW OR IN THE FUTURE AGAINST WHISKERS AND SODA CAT CAFÉ AND ITS SHAREHOLDERS, DIRECTORS, OFFICERS, EMPLOYERS, VOLUNTEERS, AND AGENTS FOR ANY INJURIES OR DAMAGES I OR MINOR CHILD SUFFER WHILE VISITING WHISKERS AND SODA CAT CAFÉ.
